Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Craft Club mobile application, website, and related services (collectively, the "Service") operated by Craft Club Labs, Inc., a Delaware corporation ("Craft Club," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

The Service is intended solely for individuals 21 years of age or older and located in the United States.

By creating an account or using the Service, you represent and warrant that:

  • You are at least 21 years old; and
  • You are legally permitted to consume alcoholic beverages in your jurisdiction.

We reserve the right to request proof of age at any time, and to suspend or terminate accounts that fail to meet this requirement or provide satisfactory verification.

2. Accounts and Registration

You must create an account and be logged in to access most features of the Service. Some features – such as viewing content shared with you or booking a seat at a Rounds session (Section 7.2) – are available without an account.

You agree to:

  • Provide accurate and complete information during registration;
  • Maintain the security of your account credentials; and
  • Be responsible for all activity that occurs under your account.

You may use a pseudonym. You are not limited to one account per person.

3. Account Suspension and Termination

We may suspend or terminate your account, or restrict access to the Service, at our sole discretion, including but not limited to if you:

  • Violate these Terms;
  • Engage in abusive, harassing, deceptive, or unlawful behavior;
  • Attempt to manipulate leaderboards, events, or other features; or
  • Engage in conduct that undermines the integrity of the Service or community.

You may delete your account at any time through account settings.

4. User-Generated Content

4.1 Content You Submit

The Service allows you to create, post, upload, and share content, including but not limited to:

  • Captions
  • Tasting notes
  • Beer reactions or ratings
  • Comments
  • Photos
  • Lists and collections
  • Profile information
  • @mentions or tagged text

(collectively, "User Content").

You are solely responsible for your User Content and represent that you have all rights necessary to submit it.

4.2 Ownership and License

You retain ownership of your User Content.

By submitting User Content, you grant Craft Club a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, host, store, reproduce, modify, display, distribute, and create derivative works of such content for the purpose of operating, improving, promoting, and marketing the Service, including on third-party platforms, app store listings, and social media.

4.3 Content Removal and Account Deletion

You may delete individual pieces of User Content through the Service.

If you delete your account:

  • Personal identifiers such as your username, avatar, and profile information will be removed; and
  • Your public User Content may be retained in anonymized form (without identifying you) to preserve the integrity, continuity, and historical record of the Service.

4.4 Moderation

We reserve the right, but have no obligation, to monitor, review, or remove User Content at any time for any reason.

We do not guarantee the accuracy, quality, or appropriateness of User Content and are not responsible for content posted by users.

5. Copyright and DMCA Notice

Craft Club respects the intellectual property rights of others and expects users to do the same.

If you believe that any content on the Service infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our designated agent with the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material;
  • Your contact information, including address, telephone number, and email address;
  • A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law; and
  • A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

We may remove or disable access to allegedly infringing material and may terminate repeat infringers in appropriate circumstances.

6. Alcohol-Related Disclaimers and Brewery Relationships

Craft Club is a discovery and social platform. We do not sell alcohol and do not encourage excessive or irresponsible consumption.

You acknowledge and agree that:

  • Craft Club does not promote or endorse excessive alcohol use;
  • You are solely responsible for your alcohol consumption decisions; and
  • Craft Club is not liable for any actions, harm, or damages arising from alcohol consumption.

Breweries may claim profiles or access platform tools to manage information. Such access does not imply endorsement of user content, reviews, rankings, or opinions.

Unless explicitly stated, Craft Club is not sponsored by or formally affiliated with breweries, and breweries do not endorse user-generated content.

7. Events, RSVPs, and Rounds Bookings

7.1 Free Events and RSVPs

The Service may allow users to RSVP to events with limited capacity.

You acknowledge and agree that:

  • An RSVP does not guarantee entry to an event;
  • Entry is subject to venue capacity, safety requirements, and host discretion;
  • Craft Club is not responsible for venue admission decisions; and
  • Repeated no-shows, late cancellations, or abuse of RSVP features may result in restricted access to future event RSVPs.

7.2 Rounds Bookings (Paid Reservations)

Rounds is a paid, small-group beer tasting session held at a third-party venue. Booking a Rounds seat is a purchase, subject to the following terms in addition to the rest of these Terms.

What you are buying. The seat price shown at checkout reserves your place at the session and covers the hosted experience. The seat fee is not a purchase of alcohol, and Craft Club does not sell alcohol. Any drinks are ordered and paid for separately, by you, from the licensed venue, which is solely responsible for alcohol service, including verifying age and declining service at its discretion.

Payment. Payments are processed by Stripe and are subject to Stripe's terms. Prices are in U.S. dollars. By booking, you authorize the charge for the seat price shown at checkout. You may book without a Craft Club account; your confirmation email is your record of the booking and includes a link to connect it to an account.

Cancellations and refunds.

  • You may cancel your booking for a full refund up to 48 hours before the session's scheduled start time.
  • Within 48 hours of the start time, you may still cancel to release your seat, but the seat fee is non-refundable.
  • No-shows are not refunded.
  • Refunds are issued to the original payment method through Stripe and may take several business days to appear.
  • If we cancel a session, you will receive a full refund. If we materially change a session's date, time, or venue after you book, you may request a full refund instead of attending.

Attendance. Sessions are limited to a small number of seats and are intended for individuals 21 years of age or older; the venue may require valid identification. We and the venue reserve the right to refuse entry to, or remove, anyone who is disruptive, unsafe, or in violation of these Terms or venue rules, without refund. Repeated no-shows or abuse of the booking system may result in restricted access to future bookings.

8. Digital Collectibles ("Taps")

The Service may allow you to collect digital representations of beers or experiences ("Taps").

You acknowledge and agree that:

  • Taps are non-monetary, have no real-world cash value, and are not transferable;
  • Taps do not constitute property, currency, or investment instruments;
  • Taps are licensed to you, not owned by you; and
  • Taps are revocable and may be modified, removed, or discontinued at any time.

We reserve the right to change Tap mechanics, retire collectibles, or reset related systems at our discretion.

9. Leaderboards and Gamification

Leaderboards, rankings, and similar features are provided for entertainment and informational purposes only.

You acknowledge that:

  • Rankings may be incomplete, inaccurate, or delayed;
  • Rankings are not guaranteed to be permanent; and
  • We may recalculate, modify, remove, or disqualify leaderboard placements at any time, including for suspicious or manipulative behavior.

10. Location-Based Features and Privacy

The Service may use location-based features to display nearby breweries or experiences. Location access is optional and controlled through your device permissions.

Users may also manually select locations during check-ins.

Our collection and use of personal information, including location data, is governed by our Privacy Policy, which is incorporated by reference.

We may use third-party analytics, error-monitoring, and advertising-measurement providers to operate, improve, and promote the Service, as described in our Privacy Policy. We do not sell personal data for money.

11. Payments and Future Features

Most of the Service is free to use. Rounds seat bookings are paid reservations governed by Section 7.2.

We reserve the right to introduce additional paid features, subscriptions, rewards, or premium services in the future. Any such features will be clearly disclosed and may be subject to additional terms.

12. Prohibited Conduct

You agree not to:

  • Harass, threaten, or abuse others;
  • Post hateful, discriminatory, or unlawful content;
  • Post, upload, or transmit child sexual abuse material (CSAM), non-consensual intimate imagery, or any content that sexually exploits minors;
  • Submit false or misleading check-ins or activity;
  • Scrape, crawl, reverse engineer, or automate access to the Service;
  • Interfere with or disrupt the Service or its systems.

We reserve the right to report any suspected illegal activity, including but not limited to child sexual exploitation, to the National Center for Missing & Exploited Children (NCMEC), law enforcement, or other appropriate authorities, and to cooperate fully with law enforcement investigations.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available."

To the fullest extent permitted by law, Craft Club disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, secure, or error-free.

14. Limitation of Liability

To the fullest extent permitted by law, Craft Club shall not be liable for any indirect, incidental, consequential, or punitive damages.

Our total liability for any claim arising out of or relating to the Service shall not exceed $100.

15. Indemnification

You agree to indemnify and hold harmless Craft Club and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of:

  • Your use of the Service;
  • Your User Content; or
  • Your violation of these Terms or applicable law.

16. Arbitration and Class Action Waiver

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, rather than in court, except that either party may seek injunctive relief.

You waive any right to participate in a class action.

You may opt out of arbitration within 30 days of first accepting these Terms by sending written notice to:

17. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

18. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
